Terms of Service

ACCEPTANCE OF TERMS AND CONDITIONS

TSOD LLC is the owner and operator of The Science of Dating. This page explains the terms by which you may use the Services. By accessing or using the Site or Service, you signify that you have read, understood, and agreed to be bound by this Terms of Use, whether or not you are a registered user of our Service. We reserve the right to amend this Agreement at any time and without notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access the Services offered by TSOD LLC.

USE OF OUR SERVICE

You will only use the Services in a manner consistent with this Agreement and any and all applicable local, state, national and international laws and regulations, including, but not limited to, United States export control laws. You are not located in, under the control of, or a national or resident of any country which the United States has (i) embargoed goods, (ii) identified as a "Specially Designated National", or (iii) placed on the Commerce Department's Table of Deny Orders. Use of the Services are void where prohibited. To the extent that the Services are not legal in your jurisdiction, your use of the Services is at your own risk. All visitors to the Site, whether registered or not, are "Users." If you register with the Site and create an account you become a "Member" or a "Subscriber" and gain access to certain features. TSOD LLC grants you permission to use the Services as set forth in this Agreement, provided that:

(a) You will only use the Services for your sole, personal use and you will not authorize others to use the Services or otherwise transfer your right to use the Services to any other person or entity.

(b) You will use the Services in a manner consistent with any and all applicable local, state, national and international laws and regulations.

(c) You will take all information,advice, and guidance provided by The Science of Dating at your own free will, The Science of Dating is not responsible for any actions taken in association with any information, guidance, or advice given from The Science of Dating.

(d) You will not use the Services to maintain any any obscene, profane, defamatory, offensive, threatening, harassing, or illegal materials that offend or violate any other party's rights.

(e) You will not use The Science of Dating services to suggest, ask, or transmit any obscene or crude questions in any form. The Science of Dating can at any time judge whether or not to answer questions put forth by members, classifying them as inappropriate or not at our own free will regardless of outside opinions.

(f) You will not post, copy, transfer, create any derivative works from, distribute, reproduce or show in any manner any copyrighted or trademarked or proprietary information or materials without the prior consent of the owner of such proprietary rights.

(g) You will only create one unique profile for the Services provided.

(h) You acknowledge that The Science of Dating may charge a fee for the use of any Services. You agree to pay any fees incurred by you.

(i) You agree that The Science of Dating has the right to investigate, prosecute you individually and/or terminate your account and cancel your subscription and/or membership if you have violated the terms of this Agreement, misused the Services, or behaved in a way which could be regarded as inappropriate, unlawful, illegal or unsafe.

(j) The Science of Dating has the right to upgrade fees for services rendered at any given time. It is your responsibility to remain knowledgable on the given prices of all current subscription plans and products.

CONTENT

You are solely responsible for the content or information that you provide, publish, display or otherwise communicate to The Science of Dating, including but not limited to materials posted on the chat room, through email messages, questions, and profiles (your submissions and those of other Users, collectively, are "Content"). You consent and license TSOD LLC to use and disclose the Content that you furnish in providing the Services.

ACCOUNT SECURITY

You understand you are responsible for maintaining the confidentiality of the username and password of your account, and you are fully responsible for all activities that occur under your username and password. You agree to (a) immediately notify TSOD LLC. of any unauthorized use of your username or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. You acknowledge that TSOD LLC. will not be liable for any loss or damage arising from your failure to comply with this provision. You agree to use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

CODE OF ETHICS

You agree to adhere to the TSOD LLC. Code of Ethics and certify that:

  1. You are at least 18 years old.
  2. You have never been convicted of a felony or any criminal offense characterized as a sexual offense.
  3. You will be truthful, accurate and complete in the information presented in your personal profile.
  4. You will not use any defamatory, abusive, obscene, profane, threatening, harassing or otherwise offensive or illegal material when using the Services.
  5. You will treat all members of The Science of Dating with respect.
  6. Your account will be immediately terminated for any violation of TSOD LLC terms of use.

REQUEST FOR INFORMATION

You agree to provide to TSOD LLC, upon request, complete, accurate and current information confirming eligibility for subscription and/or membership.

TSOD LLC RIGHTS

a. TSOD LLC Content Review; No Duty to Monitor. Although you understand and acknowledge that TSOD LLC has no duty to prescreen, control, monitor or edit the content posted by Users and is not liable for content that is provided by others, you agree and understand that TSOD LLC may, but is not required to, review, edit and delete any content, email, messages, photos or profiles that, in TSOD LLC's sole judgment, violates this Agreement or which may be offensive, illegal, unsafe or that might violate the rights of other Users.

b. Proprietary Rights. You understand that you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. The Science of Dating controls all rights to information distributed by TSOD LLC or any member of TSOD LLC.

c. Changes to Services. You understand the Services provided by TSOD LLC are expected to change from time to time and you agree that TSOD LLC has the right to modify, change, suspend or discontinue temporarily or permanently any Service offered, the features or any part of any Service offered or its system without notice, including changes to access and use procedures. You understand Zoosk will not be liable to you or any third party for any modification, change, suspension or discontinuance of the Services.

d. Blocking IP Addresses. You understand that in order to protect the integrity of the Services, TSOD LLC reserves the right at any time in its sole discretion to block members or subscribers from certain IP addresses from accessing the Services.

e. Right to deny service to users. You understand that TSOD LLC at its sole discretion reserves the right to block any user from using the services for any reason or no reason.

DISCLAIMER OF WARRANTY

THIS SECTION SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. TSOD LLC PROVIDES THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICES OR THE SITE (INCLUDING ALL INFORMATION CONTAINED THEREIN), INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

TSOD LLC DOES NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, ERROR-FREE OR WILL MEET YOUR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED. TSOD LLC DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF THE SERVICES.

TSOD LLC DOES NOT: (i) GUARANTEE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION ON THE SERVICES, OR (ii) ADOPT, ENDORSE OR ACCEPT RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY ANY PARTY OTHER THAN TSOD LLC UNDER NO CIRCUMSTANCES WILL TSOD LLC BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE'S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICES, OR TRANSMITTED TO OR BY ANY USERS.

LIMITATION OF LIABILITY

IN NO EVENT SHALL TSOD LLC BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF TSOD LLC KNOWS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES WILL TSOD LLC AGGREGATE LIABILITY, IN ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SERVICES OR THE SITE, EXCEED THE PRICE PAID BY YOU FOR YOUR ACCOUNT (IF ANY).

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TSOD LLC BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM USE OF GUIDANCE OR ADVICE.

SUBSCRIPTION AND OTHER PAID SERVICES

(a) Recurring Billing. Most subscription plans to the Services consist of recurring periodic charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. TSOD LLC SUBMITS PERIODIC CHARGES (E.G., MONTHLY) WITHOUT FURTHER AUTHORIZATION FROM YOU.

(b) Auto-renewal. Your subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional subscription rate.
